These Terms of Service ("Terms") govern your access to and use of TheProPilotApp mobile application and related services (collectively, the "Service"). By using the Service, you agree to be bound by these Terms.
Important Notice: TheProPilotApp is a flight logging tool designed to assist pilots in recordkeeping. It is not a certified aviation instrument and should not be used as the sole means of compliance with regulatory requirements. Always maintain official records as required by your aviation authority.
By downloading, installing, or using TheProPilotApp, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.
You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements.
We grant you a limited, non-exclusive, non-transferable, revocable license to use TheProPilotApp for your personal, non-commercial use, subject to these Terms.

TheProPilotApp offers a free tier with limited functionality (up to 10 trips). You may use the free tier indefinitely.
Pro subscriptions unlock unlimited trips and advanced features:
All payments are processed through Apple's App Store. Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current period. Manage your subscription in your Apple ID Account Settings.
Refund requests must be made through Apple's App Store. We do not process refunds directly. Apple's refund policy applies to all purchases.
We reserve the right to change subscription prices. You will be notified of any price changes at least 30 days in advance. Continued use of the Service after a price change constitutes acceptance of the new price.
You retain all rights to your flight log data. We do not claim ownership of any data you enter into the app.
You are solely responsible for the accuracy of data entered into the app. TheProPilotApp provides tools for calculation and recordkeeping, but you must verify all entries for accuracy and completeness.
While we provide CloudKit sync and export features, you are responsible for maintaining your own backups of important flight data. We recommend regular CSV exports.
IMPORTANT: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TheProPilotApp is NOT:
You are solely responsible for compliance with all applicable aviation regulations, including FAR 61, FAR 117, FAR 121, FAR 135, and international equivalents. TheProPilotApp is a supplementary tool only.
While we strive for accuracy in duty time calculations, you must independently verify all calculations before relying on them for regulatory compliance. Settings and buffers must be configured correctly for your specific operation.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEPROPILOTAPP AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR:
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS LESS.
You agree to indemnify, defend, and hold harmless TheProPilotApp and its developers from any claims, liabilities, damages, losses, and expenses arising from:

TheProPilotApp, including its design, features, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks or branding without prior written permission.
The Service integrates with third-party services (Apple iCloud, App Store, etc.). Your use of these services is subject to their respective terms and policies.
These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved through:
You agree to resolve disputes on an individual basis only and waive your right to participate in class actions or collective proceedings.
These Terms, along with our Privacy Policy, constitute the entire agreement between you and TheProPilotApp.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
